The innocuous prayer is being made by the petitioners seeking direction against the respondent -authority to decide the representation submitted by the present petitioners on 11/02/2025.

The petitioners vide representation dated 11/02/2025 are requesting strict action against the nonapplicants therein for carrying out the illegal construction without sanction.

Learned counsel for the petitioners submits that almost more than fifteen months have passed since the aforesaid representation was submitted to the respondentauthority. However, despite passage of sufficient time the respondent-authority has neither rejected such representation nor initiated any action against the non-applicants therein. Therefore, the petitioner has approached this Court.

In view of the fact that the statutory responsibility is cast upon the Nagpur Municipal Corporation to supervise the unauthorized construction within its limits, we pass the following order:
i] The respondent No.2 is directed to consider/decide the representation dated 11/02/2025 submitted by the petitioners within a period of six weeks from the date of production of order of this Court.
ii] The respondent No.2 shall take decision on its own merit and in accordance with law after granting an opportunity of hearing to all the necessary parties especially the non-applicants mentioned therein in the representation.
iii] The decision taken thereupon shall be communicated to the petitioners within a period of two weeks from the date of decision.
The writ petition stands disposed of, accordingly. Pending applications, if any, also stand disposed of. No order as to costs.
