When this Court inquired the learned counsel for the petitioner as to whether, for the reliefs prayed in the present petition, the petitioner could approach the competent Civil Court by seeking such reliefs, including a declaration of title on the basis of a registered sale-deed and an injunction against the respondents from disturbing his peaceful possession of the suit property. 2.

Shri. Salway, learned counsel for the petitioner, submits that the petitioner has already approached the competent Civil Court and there are certain orders passed in the said proceedings. However, upon perusal of the present petition, it is revealed that not a single fact, regarding the pendency of such civil proceedings or the orders passed therein, is pleaded in the memo of petition, nor any such document pertaining to the said proceedings is annexed to the present writ petition.

In view of the above, the learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file a fresh petition by placing on record all the aforesaid facts and the orders passed therein. Permission is granted. 4.

The present writ petition is disposed of as withdrawn with liberty as prayed for.
