Kathane, learned counsel for the petitioners submits that without issuing independent notices or without assigning any specific reason, only on the ground that the land is required for development of market, notice for eviction came to be issued on 24/04/2026 directing the petitioners to vacate the shops in possession of the respective petitioners in three days.

Issue notice to the respondents, returnable on 06/05/2026. 3.

Shri H. D. Marathe, learned Assistant Government Pleader waives service of notice for respondent Nos.1, 3 and 4. 4.

The petitioners are permitted to serve the respondent Nos.2 and 5 by private mode, in addition to the regular mode of service and file an affidavit by next date, failing which the petitioner shall deposit costs of Rupees Five Hundred with the 'Public Welfare Account' bearing No.129712010001014, IFSC Code UBIN0812978, Union Bank of India, Branch High Court, Civil Lines, Nagpur.

In the mean time, respondents are directed to maintain status quo as regards possession of the petitioners over the shops in question. 6.
