:
SMT. M.S. JAWALKAR AND NANDESH S. DESHPANDE, JJ.
DATE :
29.04 .2026 ORAL JUDGMENT (PER :
NANDESH S. DESHPANDE, JJ.
) Heard.
cir 4 wp 3629-2026.odt 2/3 2.
Issue notice to the respondent.
3.
Learned Assistant Government Pleader waives notice for the sole respondent/State.
4.
Rule. Rule is made returnable forthwith. Heard finally with the consent of the parties.
5.
In view of the limited and innocuous prayer in the petition, we do not think it fit to call for any reply from the learned Assistant Government Pleader.
6.
The Petition seeks a direction to the Scrutiny Committee to decide the Tribe claim of the petitioner for 'Mana' Scheduled Tribe as expeditiously as possible and within a particular time frame. 7.
On 02.03.2020, Deputy Collector/Sub-Divisional Officer issued a tribe certificate in favour of the petitioner No.1 and on 15.12.2021, issued in favour of petitioner No.2. Thereafter, on 12.11.2021, the petitioner No.1 and on 31.10.2021, petitioner No.2 approached the Scrutiny Committee for verification of the said claim and for grant of validity certificate. The said claim is still pending with the Scrutiny Committee. In view of the fact that the
cir 4 wp 3629-2026.odt 3/3 petitioners are intending to pursue their career in B.Ed. and wish to take higher education, they apprehend that the non-availability of the validity certificates can be an impediment to their prospective studies. They have therefore applied to this Court for grant of direction as stated supra.
8.
We have considered the contentions canvassed by the learned Counsel for the parties. As can be seen, the proposal for validity is already pending with the Scrutiny Committee since 12.11.2021 and 31.10.2021. In view of the same, we direct the Scrutiny Committee to decide the said claim as expeditiously as possible and not later than three months from the date of this order. 9.
The petitioners to submit this order of this Court to the Scrutiny Committee on 05.05.2026 to avoid any further complication.
10.
The petition is disposed of in the above terms. 11.
Rule accordingly. No order as to costs.
