The petitioners seek direction of this Court to complete the regularisation process pertaining to the plots owned by the petitioners in Trivedi Layout, Khasra No.12/2, Mouza Jaitala, Nagpur.

Perusal of communication dated 10/10/2024 issued by the Building Engineer (West), Nagpur Improvement Trust, Nagpur (record page 219 (Annexure-J) reveals that the major legal hurdle in such regularisation of the plots of the petitioners is that the regularisation of the aforesaid layout itself has been rejected by the NIT on 02/08/2011 for the reason of non-submission of measurement plan i.e. K-prat and khasra part plan from City Survey Department 4.
Shri Dhore, learned counsel submits that the petitioners are pursuing the Authorities for such measurement from 2002 so that the City Survey department shall issue the required form i.e. K-prat and part plan, however the respondent-Authority has not acted upon such request till date.

In view of the above, we dispose of the present writ petition with a direction to respondent No.6-City Survey Officer3, Civil Lines, Nagpur to treat the present writ petition as a representation on behalf of the petitioners for the relief claimed in prayer clause (2) that is to carry out fresh and accurate measurement and demarcation of the entire layout and individual plots, correct the K-Prats of the petitioners and deliver certified copies thereof.

The respondent No.6 shall decide the aforesaid representation on its own merit and in accordance with law within a stipulated period of eight weeks from the date of production of the order of this Court.

The petitioners undertake to produce copy of the order of this Court so also copy of the present writ petition alongwith its annexures before the respondent No.6 within a period of one week from today.

The decision taken thereupon shall be communicated to the petitioners within a period of two weeks from the date of such decision.
