2] The petitioner seeks challenge to the impugned show cause notice dated 27/2/2026, which is at record page 61 (Annexure - N). The learned Counsel for the petitioner submits that though the petitioner has challenged the aforesaid show cause notice before this Court in the present petition, however, the petitioner has already submitted his reply to the aforesaid show cause notice raising contentions in favour of the petitioner. He further submits that though reply is filed to the aforesaid show cause notice dated 27/2/2026, till date, the respondents have not adjudicated upon the same. 3] In view of above, we dispose of the present petition in view of the fact that there is no final adjudication at the hands of the respondents regarding the aforesaid show cause notice dated 27/2/2026. In case if the respondents decide the aforesaid show cause notice
115-WP-3651-2026 dated 27/2/2026 after considering the contentions raised by the petitioner in the present petition so also in the reply to the aforesaid show cause notice, and if the decision goes adverse to the petitioner, the same shall be kept in abeyance for a period of 15 days in order to give an opportunity to the petitioner to assail the same before the appropriate authority under the appropriate provisions of law. Needless to mention that since the aforesaid show cause notice is regarding the proposed adverse action to be taken against the petitioner, which includes monetary benefits also, the respondents shall grant an opportunity of hearing to the petitioner before arriving at such decision.
4] The petition is disposed of in above terms.
No costs.
