Heard Ms. Madhura Bhande, learned counsel for petitioner.

The petitioner has approached this Court seeking direction to respondent No.3 - Joint Director, Higher Education, Nagpur, to implement the Clause 6.4 (C) (I) (i) of UGC Regulation dated 18.07.2018. The petitioner also seeks a direction to revise his date of promotion from the date of eligibility.

However, a perusal of the petition reveals that such claim of the petitioner has not yet been rejected by respondent No.3 - Joint Director, Higher Education, Nagpur. The petitioner has submitted a detailed representation on 19.01.2026 to respondent No.3, which is at record page No.217 (Annexure - I). 4.

Ms. Bhande, learned counsel for petitioner, submits that till date, such representation is not yet decided and hence, the petitioner has alternatively vide prayer Clause (d) has prayed for a direction to respondent No.3 to decide the aforesaid representation submitted by the petitioner.

In view of the above, we dispose of the present writ petition with a direction to respondent No.3 - Joint Director, Higher

113 WP-3872-2026 Education, Nagpur, to decide the aforesaid representation dated 19.01.2026 on its own merits and in accordance with law within a stipulated period of eight weeks from the date of production of the order of this Court.

The petitioner shall also produce before the respondent No.3 a copy of the present writ petition alongwith its annexures for further consideration of the claim as raised by him. 7.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.

Needless to mention that if the petitioner is entitled, the respondent No.3 shall grant the benefits as claimed in the representation to the petitioner and in case, if the order is adverse to the petitioner, the petitioner shall be at liberty to challenge the same before the appropriate forum.
