Shwetanshu Dev, learned counsel for petitioner, upon instructions, seeks permission to withdraw the present writ petition with liberty to challenge the final order under Section 147 of the Income Tax Act, 1961 before the Appellate Authority under Section 246(1)(b) of the aforesaid Act. Permission is granted. 2.

The present writ petition is disposed of as withdrawn with liberty as prayed for.

Needless to mention that the learned Appellate Authority shall consider the period spent by petitioner before this Court in seeking challenge to the impugned show cause notice dated 29.08.2024 under Section 148 of the aforesaid Act, till today.
