The present petition is filed challenging the order dated 28.04.2026 passed by the learned District Judge-15, Nagpur, in Civil Misc. Application No.1033 of 2025, whereby the application for condonation of delay in filing appeal under Section 96 of the Code of Civil Procedure came to be rejected. The order is amenable to challenge in second appeal under Section 100 of the CPC. 2.

The learned advocate for the petitioners seeks permission to withdraw the writ petition with liberty to file second appeal. Writ petition is disposed of as withdrawn with liberty as prayed for.
