Heard Shri Uday Dable, learned counsel for the petitioner. 2.
The petitioner-borrower has approached this court raising a grievance as to the non-compliance of order dated 17.3.2026 passed by this court in Writ Petition No.986/2026.

Shri Uday Dable, the learned counsel submits that vide order dated 17.3.2026, this court had directed the learned DRT, Nagpur to decide the Interim Application No.1698/2025 and other pending Interim Applications within a period of two months from the date of the order.

The learned Presiding Officer, DRT, Nagpur instead of deciding the aforesaid Interim Applications, as directed by this court, has placed the main Securitization Application along with the aforesaid Interim Applications for hearing on 7.05.2026. 5.
Shri Dable, learned counsel, has tendered across the bar the Pursis dated 8.5.2026. placing on record the Roznama dated 7.5.2026, which reveals that now the aforesaid proceedings are posted for final hearing on 8.5.2026.

In view of the above, the petitioner has approached this court that though this court had directed the learned Tribunal to decide the Interim Application, the Tribunal has taken up the main
2 02 WP 4066.26.odt matter for hearing along with the interim applications. The perusal of the order dated 17.3.2026, reveals that there was no such prohibition for the learned Presiding Officer, DRT, Nagpur for taking up the matter on merit finally.

However, if the Interim Applications are also placed on record for final hearing along with the Securitization Application, it is expected that the learned Tribunal shall decide those interim applications first while deciding the main proceeding bearing S.A. No.298/2022. In case, if the aforesaid proceedings are decided finally adverse to the petitioner, the aforesaid order shall be kept in abeyance for a period of 15 days in order to enable the petitioner to approach the learned DRAT, Mumabi for challenging the order passed by the learned DRT, Nagpur against the petitioner.

In view of above, the writ petition is accordingly disposed of.
