Application for waiving the statutory period of six months, as prescribed under Section 13B (2) of the Hindu Marriage Act, 1955, filed by the petitioners in Petition No.F-362/2026, which is a petition filed for seeking divorce by mutual consent, came to be rejected by the learned Principal Judge, Family Court, Nagpur vide order dated 16/05/2026 on the ground that the date of marriage and the date of separation is not mentioned in the application. 2.

The learned Advocates for the petitioners/ husband and wife respectively draw attention to paragraph No.1 and 3 of the Marriage Petition, wherein the date of marriage and date of separation are mentioned. The date of marriage is 03/07/2022 and the date of separation is 03/02/2024.

In view of the aforesaid, the impugned order, dated 16/05/2026 is quashed and set aside. The learned Principal Judge, Family Court, Nagpur to decide the

38. WP 4557 of 2026.odt application at Exh.6 in Petition No.F-362/2026 afresh taking into consideration the contents of the Marriage Petition as well while deciding the said application at Exh.6. 4.

Parties to appear before the learned Principal Judge, Family Court, Nagpur on 15/06/2026.

Parties to note that separate notice for appearance will not be issued.

Writ Petition is disposed of accordingly. No order as to costs.
