Heard Mr. Ajay Menon, learned Advocate for the Petitioner, Mr. Shubham Priolkar, learned Additional Government Advocate for Respondent Nos. 1 to 5, Mr. Shahapurkar, learned Advocate for Respondent No. 6 and Mr. Ganesh Naik, learned Advocate for Respondent No. 7.
2. In view of the urgency expressed by Mr. Ajay Menon, this Petition was taken up on 28.05.2026 and notices were issued to the Respondents.
3. The grievance of the Petitioner is that despite the Respondent No. 6 (Panchayat) issuing a stop work notice dated 22.05.2026 to the Respondent No. 7, directing the Respondent No. 7 to stop the construction activities in the property bearing Survey No. 355/25 situated in Mandrem village, the Respondent No. 7 continues to carry out the construction with impunity.
4. Today, Mr. Ganesh Naik appeared on behalf of Respondent No. 7 and on instructions from Respondent No. 7, states that Respondent No. 7 has stopped the construction activities as on date. He states that the Respondent No. 7 shall not undertake any construction activities in the property bearing Survey No. 355/25 situated in Mandrem village till the subsistence of the stop work notice dated 22.05.2026. He states that the said statement is based on the instructions of Respondent No. 7 and may be accepted as an undertaking to the Court. The statement is accepted.
5. Mr. Shahapurkar, learned Advocate for Respondent No. 6 (Panchayat), confirms that the construction activities in the property bearing Survey No. 355/25 situated in Mandrem village are stopped and the Respondent No. 6 will ensure compliance of its stop work notice dated 22.05.2026.
6. In view of the above, Mr. Ajay Menon, learned Advocate for the
Petitioner, on instructions from the Petitioner, states that the grievance of the Petitioner is resolved and this Petition be disposed of. He submits that the Petitioner would adopt civil remedies and/or any other remedies that may be available in law before the Civil Court/ Authorities having jurisdiction.
