The applicant seeks review of order dated 17.02.2016 passed in Writ Petition No.7300 of 2025 and seeks modification of order to the extent of observations made in para 7 to 9. 2.
Mr. Gastgar, learned advocate appearing for applicant submits that while passing order dated 17.02.2026 in Writ Petition No.7300 of 2025, it has been observed in para 7 and 8 that "admittedly, application under Section 41-A of the Act has been filed before Deputy Charity Commissioner and Deputy Charity Commissioner shall take his own decision expeditiously after hearing rival groups and in any case within a period of Ten (10) weeks from today." However, application under Section 41-A was already rejected by Deputy Charity Commissioner vide order dated 04.02.2026. Mr. Gastgar further points out that review petitioner has already filed
P4-RA-41-2026.odt (2) review to order passed under Section 41-A before Deputy Charity Commissioner and if this Court directs concerned authority to decide same on its own merit, that will serve purpose of filing this review application.

Mr. Jamalpurkar, learned advocate appearing for respondents opposed review application.

In view of fact that application under Section 41-A was decided on 04.02.2026 i.e. prior to decision in Writ Petition No.7300 of 2025 and applicant has already filed review against order passed by Deputy Charity Commissioner under Section 41-A, it would be appropriate for Deputy Charity Commissioner to consider and decide said review application on its own merit without being impeded by observations in para 7 and 8 of order dated 17.02.2026 in Writ Petition No.7300 of 2025.

With aforesaid observations, review application stands disposed of.
