By these applications, the applicant is seeking condonation of delay in filing application for bringing legal representatives of deceased son of respondent No.8 on record and for setting-aside abatement as well as for bringing on record the legal representatives of deceased son of respondent No.8.

Advocate Mr. Nemade, appears on behalf of respondent Nos.5 and 6. Although he opposed the applications, having regard to the contents of the applications and submissions advanced in the interest of justice, the applications need to be allowed. Hence, the civil applications are allowed. Abatement is set-aside. Delay of 590 days in filing application for bringing the legal representatives of deceased son of respondent No.8 on record is hereby condoned. Petitioner is permitted to bring the legal representatives on record and carry out necessary amendment within a period of one week.

After the amendment is carried out, issue notice to the newly added respondent Nos.8(a) and 8(b), returnable after vacation.

Petitioner is permitted to serve the newly added respondents by private mode, in addition to regular mode of service and file affidavit of service in that regard by next date.
