On previous date, following order was passed. "The petitioner has approached this Court saying that he is entitled for compulsory retirement benefit.

Learned counsel for the respondents submits that pension due and payable has been paid. Petitioner was compulsorily retired by way of punishment, therefore, he is not entitled for pension and for encashment of earned leave.

Learned counsel for the respondents seeks time to file documents in support of his argument. 4.

Time is granted.

In support, learned counsel for respondent no. 1 filed documents along with Civil Application (CAW) No. 156/2026 dated 19-1-2026 for taking the documents on record. The civil application is allowed. 3.

The documents include table showing extract of pension paid till December, 2025. Learned counsel

Order wp 5415.2016.odt for respondent no. 1 submits that pension is regularly paid. The statement is accepted. As regards payment of encashment of leave, the respondent has maintained a stand that since the petitioner was compulsorily retired, he is not entitled for leave encashment. Communication to that effect along with circular dated 11-5-2025 is annexed with the civil application. 4.

None is appearing for the petitioner to counter the submissions.

In view of the above, we accept the decision taken by the respondents to refuse to grant leave encashment.
