DATE : 10.04.2026 By this application, the petitioner seeks substitution of name of the Managing Trustee of respondent No.12, who is reported to have expired. Advocate Mr. Johrapurkar, learned counsel for respondent Nos.1, 3 to 6 does not have objection. Considering the reasons mentioned in the application, the application is allowed.

The name of respondent No.12 is permitted to be substituted by the new Managing Trustee. 5.
Necessary amendment be carried out within a period of one week.
2 / 3 3.caw625.2026 Civil Application (CAW) No.471/2026 This is an application filed by the respondent Nos.1, 3 to 6 for modification of the interim order dated 01.10.2025 passed by this Court in this petition. Learned counsel for the respondent Nos.1, 3 to 6 submits that the instant petition is filed on behalf of only three allottees and the interim order cannot be applied to the case of the fourth allottee (Bharatsingh Natthusingh Rajput) and his legal heirs. It is therefore, submitted that the interim order be appropriately modified by clarifying that it is not applicable to the fourth allottee. The prayer clause (1) of the civil application reads as under :
"(1) Modify the ad-interim order passed on 01.10.2025 and it be held that the ad-interim order would not be applicable to allottees Bharatsingh Natthusing Rajput for Survey No.8/2, admeasuring 1.26 acres and allotee Survey No.13/1A, admeasuring 2.38 acres both of village Fattepur, Tah. Akot, Dist. Akot and the present respondents are at liberty to execute the order passed by the Maharashtra Revenue Tribunal on 20.01.2025 in Proceeding No.APL/Ceiling/AKO-01/2018 to that extent."
Learned counsel for the petitioners have no objection for allowing this application by modifying the interim order with the aforesaid clarification.

The interim order dated 01.10.2025 is modified and it is clarified that it would not be applicable to the legal representatives of the original allottee Mr. Bharatsingh Natthusingh Rajput.

In view of this, the civil application is allowed and disposed of.
Writ Petition No. 5843/2025 Learned counsel for petitioners, on instructions, seeks leave to delete the respondent Nos.8b, 8c, 8e and 8f at its own risk.
Leave granted. The petitioners are permitted to delete the respondent Nos.8b, 8c, 8e and 8f at their own risk. Necessary amendment be carried out within a period of one week.
Learned counsel for the respondent Nos.1, 3 to 6 seeks leave to place on record annexures as referred in the reply. Leave granted.
