IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

CIVIL APPLICATION (CAW) No.1234 OF 2026 IN WRIT PETITION No.4610 OF 2023 (Madhukar s/o. Shankar Jawanjal Vs. The Vice Chairman/Member Secretary, Schedule Tribe Caste Certificate Scrutiny Committee, Amravati and another) __________________________________________________________________________ Office Notes, Office Memoramda of Coram, appearances, Court's orders of directions Court's or Judge's orders.

and Registrar's Orders.

Mr. C.J. Dhumne, Advocate for Petitioner.

Ms. Prachi Joshi, AGP for respondent State.

CORAM : NANDESH S. DESHPANDE, J.

DATE : 22 nd MAY, 2026.

1.

The present application is filed seeking modification of clause (iv) of the operative portion in Judgment dated 7.5.2026 to the extent of directing the respondent No.2 to release the pension and other retiral benefits within four weeks from the date of submission of caste validity certificate by the petitioner with the respondent No.2.

2.

I have perused the said judgment passed in Writ Petition No.4610/2023.

3.

By way of said judgment while allowing the writ petition this Court had quashed and set aside the invalidation order dated 15.9.2021 passed by the respondent No.1. It was further directed that the said respondent No.1 would issue caste validity certificate in favour of petitioner certifying him as belonging to "Thakur" Scheduled Tribe within a period of four weeks from the date of receipt of a certified copy of the order.

7-wp4610.23.odt 2/2 4.

It was also directed that the respondent No.2 i.e. the present applicant Deputy Director General of Meteorology, Regional Meteorological Centre, Nagpur to release all pensionary and retiral benefits to the petitioner within a period of four weeks from the date of receipt of the certified copy of the order of the judgment.

5.

It seems that the period of four weeks in clause (iii) and (iv) are overlapping, and therefore clause (iv) of the operative part of the said judgment dated 7th May, 2026 is modified as under :

"The respondent No.2/Deputy Director General of Meteorology, Regional Meteorological Centre, Nagpur is directed to release all pension and retiral benefits to the petitioner within a period of four weeks from the date of receipt of validity certificate of the petitioner and the said authority shall not take any coercive action against the petitioner in relation to his service benefits on the basis of invalidation order, which stands quashed."

6.

The modified 'clause (iv)' in the operative part be inserted in the Judgment dated 7th May, 2026 and the corrected copy be uploaded accordingly, 7.

Civil application is disposed of.
