DATED : 06.02.2026 Civil Application No. 845/2026 is for setting aside abatement and permission to bring legal representatives on record and Civil Application No. 846/2026 is filed for condonation of delay in filing application for bringing legal heirs on record and setting aside the abatement.

It is the contention of the appellant that the appellant No.1 has expired on 15.10.2025 at Nagpur leaving behind the appellant No.2 and two daughters as mentioned

The learned Counsel for the respondent Nos.1, 2 and 3 have no objection for allowing the applications. 4.

In that view of the matter, both the applications are allowed. Delay of 20 days in filing application for bringing legal representatives and setting aside abatement is condoned. Abatement is set aside and appellant is permitted to bring the legal representatives on record. 5.

Both the applications are disposed of.
