On 26.2.2024, the appellant was granted three week's time to file paper book and it was made clear that appeal shall stand dismissed, if the peper book is not filed. Accordingly, as paper book was not filed, on 18.3.2024, the matter was dismissed in default.

The claimants have preferred the application praying for withdrawal of amount deposited by the appellant. Since the appeal is already dismissed in default, Civil Application 1201/2026 is allowed in terms of prayer clause (a). 4.

The application is disposed of accordingly.
