This is an Application for apportionment of the compensation amount among the Respondent Nos.1 and 3 as the Respondent No.2 is no more.

Undisputedly, the Respondent Nos.1, 2 and 3 had preferred the Application for compensation and the same was allowed. The vehicle owner had preferred the First Appeal No.1220/2013, which came to be partly allowed and the liability was fastened on the Insurance Company. The only question is of apportionment between the surviving Respondents/Claimants.

In the Application, which is supported by the affidavit, it is stated that, the Respondent Nos.1 and 3 are the remaining legal representatives of the deceased Galfas Premdas Jivne. The copy of the Death Certificate showing the name of the Respondent No.2 as the deceased is enclosed with the Application. Hence, the Application is allowed in terms of prayer clause - a.

The amount be distributed equally among the surviving Claimants.
