This is an application for proposed amendment in the nature of amending the petition, and also seek permission to delete the name of the respondent no. 1 Smt. Sushilaben Wd/o Shri Shanabhai Patel, in the cause title. 2.

As per the contents of the said application, vide pursis dated 08.01.2026, the respondents have placed on record the death certificate dated 10.09.2023 informing about the death of the respondent no. 1 therein. It was also Shubham

(2) 953.FA283.12 informed that the legal heirs of deceased respondent no. 1 are already on record.

For the reasons stated in the application, the Civil Application is allowed. The appellant is permitted to amend the appeal memo, and thereby deleting the respondent no. 1 in the cause title.

The Civil Application is disposed of.

CROSS OBJECTION NO. 27 OF 2012 1.

Since we have already allowed Civil Application (CAF) No. 1308 of 2026, thereby permitting to amend the appeal memo in as much as to delete the name of the respondent no. 1, leave is also granted to carry out the amendment in the cross-objection within one working week from today.
