No.1421/2026 in First Appeal No.383/2020 Coram : Registrar(Judicial) Dated : 07.04.2026 The civil application is filed by appellant under Order V Rule 20 of the C.P.C., 1908 for substituted service upon Respondent No.2 by way of paper publication. It is contended that notice issued to respondent No.2 received back unserved for want of correct address.
As per bailiff report, the house of respondent No.2 is locked and several years ago he is shifted at Nagpur. Appellant also contended that he has only have last known address of respondent No.2 and could not ascertained new address of Respondent No.2. Thus, the appellant wants to serve Respondent No.2 by way of paper publication.
Hence, considering the reasons mentioned in the application, the same is allowed. Substituted service be effected upon Respondent No.2 by publishing a notice in widely circulated local daily newspaper 'Deshonnati (Marathi)", Nagpur Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.
