By the present application filed under Section 5 of the Limitation Act, 1963, the applicant-acquiring body seeks condonation of delay of 5 days caused while lodging the appeal against the judgment and award dated 25/10/2023 passed in Case No.1471/AMT/AMT/2020 by the learned Presiding Officer, Land Acquisition, Resettlement and Rehabilitation Authority, Nagpur.

The learned Counsel appearing for non-applicant No.1 has not seriously objected to the condonation of delay of 5 days. The learned A.G.P. submits that suitable order may be passed. 04.
For the reasons and explanation offered in the application, the delay of 5 days caused while lodging the appeal is hereby condoned. 05.
The Office to register the appeal. The application is allowed and disposed of accordingly.

By the present appeal, the appellant-acquiring body takes exception to the judgment and award dated 25/10/2023 passed in Case No.1471/AMT/AMT/2020 by the learned Presiding Officer, Land Acquisition, Resettlement and Rehabilitation Authority, Nagpur. 02.
Issue notice to the respondents, returnable on 25th June, 2026. 03.
Learned Counsel Mr. Parag Rathi waives service of notice for respondent No.1 and learned A.G.P. Mr. H.D. Dubey waives service for respondent Nos.2 and 3.

In the meantime, the appellant shall file private paper-book. Civil Application [CAF] No.1460/2025:
By the present application, the applicant-acquiring body seeks time to deposit the entire amount of compensation by Cheque No. 265056 dated 16/03/2026, to the tune of Rs.15,30,888/-. 02.
Accordingly, two weeks' time is granted to deposit the said amount.

The Office is directed to accept the same. The application is allowed and disposed of accordingly.
