Heard the learned Counsel appearing for respondent Nos.1 to 3 - original claimants and the learned Counsel appearing for the appellant - Insurance Company.

By the present application, the applicants - original claimants seek permission to withdraw the entire amount of compensation to meet educational and other expenses.

The learned Counsel for the Insurance Company raises no objection to grant permission for withdrawal of 50% of the compensation amount. Needless to say that on 17/02/2025, the learned Member, M.A.C.T., Yavatmal, passed the impugned judgment and award in M.A.C.P. No.130/2020 thereby directing the appellant - Insurance Company as well as the owner and driver of the offending vehicle to pay compensation of Rs.92,19,003/- on account of the accidental death of deceased Vijayrao Bhurewar, husband of appellant No.1 and father of appellant Nos.2 and 3.

In order to meet the educational and other expenses, it would be just and proper to permit the original claimants to withdraw 50% of
32.fa.1039.25 2/2 the compensation amount along with accrued interest upon furnishing an usual undertaking to the satisfaction of the Registrar (Judicial) of this Court. The remaining 50% amount shall be kept in a Fixed Deposit, renewable from year to year.

The civil application stands disposed of accordingly. Civil Application [CAF] No.2875/2025:

Since the appellant - Insurance Company has deposited the entire award amount in pursuance of the judgment and award dated 17/02/2026 passed in M.A.C.P. No.130/2020 by the learned Member, M.A.C.T., Yavatmal, the effect, operation and execution of the impugned award are hereby stayed.
