By the present application filed under Section 5 of the Limitation Act, 1963, the applicant-acquiring body seeks condonation of delay of 59 days caused in filing the appeal challenging the judgment and award dated 05/08/2025 passed in Case No.2532/AMT/BLD/20 by the learned Presiding Officer, Land Acquisition, Resettlement and Rehabilitation Authority, Nagpur.

The learned Counsel appearing for non-applicant No.1 has not seriously objected to the condonation of delay. 04.

In view of the above, the delay of 59 days caused while lodging the appeal is hereby condoned on the grounds set out in the application. Office to register the First Appeal. 05.

By the present application, applicant/respondent No.1 seeks withdrawal of the entire amount of compensation granted under the judgment and award dated 05/08/2025 passed in Case No.2532/AMT/BLD/20.

For the reasons stated in the application, applicant/ respondent No.1 - original claimant is permitted to withdraw 75% of the amount of compensation upon furnishing an undertaking to the satisfaction of the Registrar (Judicial) of this Court. 03.
