On the grounds set out in the application, as such the cause of action survives hence, the appellant is permitted to bring legal heirs of deceased respondent no. 1 on record.

The application is disposed of accordingly.

The appellant- insurance company has filed a pursis no. 8/2026 and seeks permission to withdraw the appeal.

Accordingly, the appeal is disposed of as withdrawn.

The admissible court fees be refunded to the appellant and the balance amount of compensation, if any lying with this Court, shall be disbursed to the respondents along with accrued interest thereto. 9.
Respondent no. 1(2)- Aman Dinesh Shahu being minor therefore, his share of compensation be kept in FDR till he attained majority.
