Heard the learned counsel for the respective parties.

Having regard to the submissions canvassed by both sides, I have gone through the record. 3.

It is not in dispute that the AppellantsAcquiring Body has acquired the land of the present respondent no.1-Claimant to the extent of 0.69 R, out of Survey no. 11/1-C mauja Borakhadi, Tq. Ralegaon, District Yavatmal.

On 13th November, 2017, the learned Trial Court passed the impugned judgment and award and granted compensation to the tune of Rs.8,00,000/- per hectare, which comes to Rs. 8,12,661/- which has been deposited by the Appellants-Acquiring Body before this Court in pursuance of the order dated 27.4.2023. Since the land of the present respondent no.1 has been acquired, and considering the needs of

2 caf1613.2026.odt the respondent no.1, it will just and proper to permit respondent no.1 to withdraw 75% of the compensation amount along with accrued interest deposited by the Appellants on furnishing usual undertaking to the satisfaction of the Registrar (Judicial) of this Court.
