By the present application, the respondent no. 1-original claimant is seeking permission to withdraw the entire amount of compensation with accrued interest awarded under the judgment and award dated 04.09.2025 passed in Claim Petition No. 782/2021 by the learned Member, Motor Accident Claims Tribunal, Nagpur (for short, "Tribunal").

On face of the record it appears that on 04.09.2025, the Tribunal passed the impugned judgment and awarded compensation of Rs.19,75,212/- on account of 50% disability sustained to respondent no. 1-claimant. RR Jaiswal

2 53-fa-118-26.odt The said judgment is assailed by the Insurance Company in the present appeal filed under Section 173 of the Motor Vehicle Act, 1988.

Considering the nature of claim as well as the need of respondent no. 1-claimant, it would be just and proper to permit her to withdraw 50% of the compensation amount deposited in this Court along with accrued interest on furnishing an undertaking that in case if the present appeal is allowed and the claim of respondent no. 1 is reversed, in that event respondent no. 1 shall have to re-deposit the entire withdrawn amount along with interest in this Court within a period of two months therefrom.

Accordingly, the application is disposed of.
