By this Application, the Appellant/Insurance Company is seeking permission to delete the name of Respondent No.4 from the array of Respondents.

The Appellant is permitted to delete the name of Respondent No.4 from the array of Respondents. 5.

This Application is filed by the Respondent Nos.1 to 3 for withdrawal of amount deposited by the Appellant/Insurance Company in this Court.

The learned Counsel for Appellant has pointed out from the Judgment of the Motor Accident Claims Tribunal - 2, Nagpur that the Claimants were allowed to withdraw the amount subject to procedure as laid down by the Hon'ble Supreme Court of India in the case of National Insurance Company Ltd. V/s Challa Upendra Rao & Ors. [2004] Supp. 4 SCR 587. Therefore, unless the owner of vehicle produced on record the security, Claimants cannot be allowed to withdraw the amount. 3.
In this matter, Respondent No.5, who is owner of the offending vehicle, is already served and the learned Counsel Mr. A. R. Ingole appeared in the matter on behalf of Respondent No.5 on 19/1/2026 and sought time to take instructions. However, after 19/1/2026 he did not appear in the matter. 4.
In the circumstances, list this matter on 22nd June, 2026 with clear understanding that if no one appeared on behalf of the Respondent No.5 on next date, appropriate order will be passed on the present Application.
