The learned Counsel for the applicant submits that the applicant entered into an agreement with the respondent dated 22/09/2019. The said agreement provides for the resolution of disputes through arbitration. Clause 172 of the agreement pertains to dispute resolution through arbitration and is reproduced below for ready reference:

"172.

If any dispute arises and persists between the Contractor and the Employer the same shall be referred to an Arbitrator appointed by Shri Saibaba Sansthan Trust, Shirdi, under the Arbitration and Conciliation (Amendment) Act 2015 and the Arbitration and Conciliation Act 1996."

The learned Counsel for the applicant further submits that certain disputes have arisen between the parties. The applicant invoked the arbitration clause by issuing a notice dated 13/10/2025 to the respondent. However, the respondent failed to respond to the said notice. In these Page 1 of
