DATE : 17.03.2026 Learned counsel for applicant seeks leave to amend paragraph No.5 of the Civil Application No.355/2026 to mention the name of bank.

Leave granted. Necessary amendment be carried out forthwith.

This is an application by the respondent-sole for directions to the appellant to deposit 50% amount of occupation charges, as per order dated 15.07.2025, directly in the Saving Bank account of the respondent. 4.

Learned counsel for respondent submits that by order dated 15.07.2025, this Court has permitted the respondent to withdraw 50% of the deposited amount, as mentioned in paragraph No.5 of the said order, which is reproduced below :

2 / 2 72.cfcas355.2026 "5. On deposit of the arrears amount of the occupation charges and also as and when the occupation charges is deposited per month by the appellant, the respondent is entitled to withdraw 50% of the deposited amount."

It is pointed out that respondent is aged about 83 years and it is not possible for him to personally visit the Court for withdrawal of the amount on every date and therefore, a request is made for transferring the amount directly in the account of the respondent, the details of which are mentioned in paragraph No.5 of the civil application.

The request appears to be reasonable and therefore, the application is allowed.

The respondent is permitted to withdraw the amount which is already deposited in accordance with order dated 15.07.2025 till today, and it is directed that, henceforth, the appellant should deposit the said amount directly in the account of respondent, until further orders. 8.

Civil application is allowed and disposed of accordingly.
