NO. 493/2026 IN SECOND APPEAL NO. 413/2023 CORAM : REGISTRAR (JUDICIAL) DATED : 23/04/2026 The civil application is filed by the appellants under Order V Rule 20 of the C.P.C., 1908 for substituted service upon R.No.7 by way of affixing copies of notice at some conspicuous part of the house of last known address of the aforesaid respondent and also at the same time requested to permit appellants to serve respondent No.7 by paper publication. It is stated in the application that notice issued to respondent No. 7 received back unserved with bailiff report that the Respondent No.7 is not residing at the given address. It is further contended that respondent No.7 is deliberately avoiding service. Thus, the appellants want to serve aforesaid respondent by affixing the notice on the last known address of R.No.7.

Hence, considering the reasons mentioned in the application, the same is allowed. Substituted service be effected upon respondent No. 7 by affixing copies of notice on some conspicuous part of his last known address as per Order 5 Rule 20(1) of C.P.C. and by publishing a notice in widely circulated local daily newspaper 'Lokmat", Amravati Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of affixing and publication of notice.
