C.A.S. No.510/2026 in Second Appeal No.41/2022 Coram : Registrar(Judicial) Dated : 23.04.2026 The civil application is filed by appellant under Order V Rule 20 of the C.P.C., 1908 for substituted service upon proposed LR of Respondent No.3 i.e.

Respondent No.3(ii) by way of paper publication. As per bailiff report respondent No.3(ii) is not residing on the given address.

Further, it is contended that the appellant only have last known address of proposed respondent No.3(ii) and no alternative address. Thus, the appellant wants to serve proposed Respondent No.3(ii) by way of paper publication.

Hence, considering the reasons mentioned in the application, the same is allowed. Substituted service be effected upon proposed Respondent No.3(ii) by publishing a notice in widely circulated local daily newspaper 'Times of India (English)", Mumbai Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.
