2.
Learned advocate for the applicant/appellant states that apart from the present appeal another appeal between the same parties bearing Arbitration Appeal No. 285 of 2025 is pending before the Division Bench of this Court. He states that like in the present appeal, order for deposing the entire amount of compensation as awarded by the Arbitral Tribunal is also passed in the appeal pending before the Division Bench. He states that while depositing amount pursuant to the order passed by the Division Bench in Arbitration Appeal No.285 of 2025, due to confusion on account of parties in both appeals being the same, amount is deposited in the present appeal i.e. Arbitration Appeal No.276 of 2025. 3.
The learned Advocate makes a request that amount deposited in present appeal i.e. Arbitration
cir..odt Appeal No.276 of 2025 be treated as deposit made in Arbitration Appeal No.285 of 2025.
4.
It appears that incorrect appeal number i.e., Arbitration Appeal No.276 of 2025 is mentioned while depositing amount pursuant to order passed in Arbitration Appeal No.285 of 2025 due to bonafide mistake.
5.
Office is directed to treat the amount deposited by the appellant/applicant-NHAI in Arbitration Appeal NO.276 of 2025 as amount deposited in Arbitration Appeal No.285 of 2025.
6.
Civil Application stands disposed of.
