Issue notice to the respondents, returnable on 9th January, 2026. 3.

Writ Petition No.4486/2021 was filed challenging the order dated 9.9.2021 passed by respondent no.1, whereby the services of the petitioner from the post of Gram Rozgar Sevak were directed to be discontinued. Vide order dated 21.1.2022 this Court on a prima facie consideration of the merits of the matter granted stay to the implementation of the impugned order dated 9.9.2021. However, the petition came to be dismissed vide order dated 7.5.2025 on account of failure on the part of the petitioner to remove office objections.

The learned Advocate for the applicant states that earlier Advocate representing the petitioner is appointed as Judicial Magistrate First Class somewhere in the year 2023, as a consequence of which the office objections could not be removed. He contends that a litigant should not be made to suffer for the mistake of Advocate. He draws attention to the notice dated 24.12.2025 issued by Gram Panchayat for discontinuing the services of

2 mca st.05.26.odt the petitioner from the post of Gram Rozgar Sevak which is scheduled to be held on 2.1.2026.

In view of the order dated 21.1.2022, it is directed that although the meeting may be held decision to discontinue the services of the petitioner, if taken in the said meeting, shall not be implemented till the next date i.e. 9.1.2026.
