Shri P. A. Kadu, learned counsel for the respondent appears and waives notice on behalf of the respondent.

For the reasons mentioned in Civil Application (CAO) No. 114/2026, the delay in filing Misc. Civil Application (ST) No. 29480/2025 is hereby condoned.

It appears that the matter was called out on 10.10.2025 but, learned counsel for the petitioners was traveling from Kolhapur to Nagpur and due to heavy rain RR Jaiswal
2 2-cao-114-26.odt fall he could not attend the Court on that day. Thereafter, on 14.10.2025 he was on his leg before the Debt Recovery Tribunal and he made alternative arrangement through local Advocate but before he could reach the Court, the matter was already called out and dismissal order had been passed.

No prejudice will be caused to the respondent if the Writ Petition is restored. Hence, considering the reasons mentioned in the application, Writ Petition No. 3904/2024 is restored to file subject to deposit of costs of Rs.5,000/- (Rs. Five Thousand only) with Tirora Bar Association, Dist. Gondia.
