CORAM : Smt. M.S. Jawalkar and Nandesh S. Deshpande, JJ. DATE : 16-04-2026.
Heard learned Counsel for the respective parties. 2.
The applicants, by this application, seek condonation of delay in filing the review application.
3.
For the reasons stated therein, the application is allowed. MCA St. No.1692/2026 By this application, review of the judgment passed in Writ Petition No. 2510 of 2023 on 08.04.2024 is sought. 2.
The entire edifice of the case of the review applicant rests upon the subsequent judgment of the Hon'ble Supreme Court in Govind Kumar Sharma and another vs. Bank of Baroda and others, reported in 2024 LawSuit (SC) 358. Admittedly, when this Court delivered its judgment on 08.04.2024, the aforesaid judgment of the Hon'ble Apex Court was not in existence, the same having been rendered later on 18.04.2024. This position is undisputed and borne out from the record.

Even otherwise, while deciding the writ petition, this Court had found the notice issued under the Security Interest (Enforcement) Rules, 2002 to be defective for various reasons. A perusal of the judgment of the Hon'ble Apex Court relied upon by the applicant indicates that it pertains only to the aspect of enhancement of interest.
4.
In view thereof, it is clear that no error apparent on the face of the record is made out so as to warrant exercise of review jurisdiction. The application is devoid of merit and is, accordingly, rejected.
