MARCH 16, 2026 CIVIL APPLICATION (O) NO. 228 OF 2026 1) The registration of Second Appeal (Stamp) No.23743/2024 came to be refused in view of failure on the part of the appellant/applicant to remove office objections in accordance with the order dated 13/11/2025, passed by the learned Registrar (Judicial). The revision application has been filed in order to assail the said order. There is a delay of around 73 days in filing the revision, for which the present application is filed. It is stated that the order passed by the learned Registrar (Judicial) was not noticed by the learned counsel, resulting into delay.

2) It is obvious that the applicant is not personally responsible for the removal of office objections, since he is engaged an advocate. It is well settled that the party should not suffer for the lapses on the part of his advocate. In view of the KOLHE

2 13-cao 228.2026.odt aforesaid the delay caused in filing the Misc. Civil Application (Stamp) No.4397/2026 is condoned.

MISC. CIVIL APPLICATION (STAMP) NO. 4397 OF 2026 3) For the reasons recorded above, Misc. Civil Application (Stamp) No.4397/2026 is allowed. The order dated 13/11/2025 passed by learned Registrar (Judicial) is quashed and set aside.

4) The second appeal be restored.

The applicant/appellant is directed to remove the office objections on or before 30/03/2026.
