This is a civil application by the respondent, i.e., the mother, seeking a direction to the non-applicant father to produce Master Raajveer before the Registrar of this Court as per the judgment in Family Court Appeal No. 42/2018 delivered on 26.07.2018. The learned counsel for the applicant / respondent wife places before us a series of orders wherein, in similar situations, this Court has granted access in compliance with the judgment referred to supra. 2.

Ms. A. S. Sharma h/f Mr. J. M. Gandhi states that the brief has already been returned to the appellant husband in December, 2022. However, there is neither any acknowledgment on record nor any application seeking discharge of the counsel. Even though, we do not disbelieve Shubham

(2) 953.FCA42.18 the learned counsel for the applicant, what is at least minimum expected is to file an application for discharge or an acknowledgment so that we can proceed with the matter. 3.

Today, Ms. A. S. Sharma h/f Mr. J. M. Gandhi also informed the Court that the appellant husband has been informed about the matter being placed before this Court at 02.30 p.m. However, nobody is present on behalf of the husband nor the husband is present in person. 4.

The learned counsel for the applicant / wife also submits that an e-mail has also been sent by the applicant intimating about the wife coming from the U.K.. It is thus clear that the husband / non-applicant is well aware of the fact. However, in view of the peculiar situation, we are constrained to issue a bailable warrant to the tune of Rs. 10,000/- (Ten Thousand Rupees), returnable on 27.03.2026.

The Bailable warrant be served to the concerned through the Commissioner of Police or through the concerned Deputy Commissioner of Police, as the case may be, compliance be reported to this Court.

Matter be kept on 27.03.2026 at 02.30 p.m.
