The respondent No.1-Collector, Akola is seized of the issue raised in the present petition. Therefore, in our view, if the Collector is directed to treat the present petition as a representation of the petitioner and to consider and decide the same in accordance with law, the purpose would be served.

Accordingly, we direct respondent No.1 - Collector to treat the present Public Interest Litigation as a representation of the petitioner and to take a decision thereon. If there is no legal impediment, the respondent No.1 shall proceed to take the matter to its logical end. 3.

The learned counsel for the petitioner undertakes to furnish copy of this order as well as the Public Interest Litigation to the respondent No.1-Collector within three weeks from today.

The decision taken shall be communicated to the petitioner within two weeks from the date of such decision. Accordingly, the Public Interest Litigation is disposed of in the above terms. No order as to costs.
