The petitioners, by way of the present Public Interest Litigation, have approached this Court seeking a declaration that the construction of a commercial complex/shops on land admeasuring 8.33 hectares situated in Survey No. 19 at Mouje Mehkar is against public interest. The petitioners have also sought other ancillary reliefs.

However, the fact remains that the petitioners have already approached the appropriate authority, namely respondent No. 2 - District Collector, Buldhana, by submitting a detailed representation dated 9th December 2025. The said representation is at record page No. 69 (Annexure-E). 4.
Mr. Dharmadhikari, learned counsel for the petitioners, submits that instead of deciding the said representation, the respondents are proceeding further with the construction activities and hence the petitioners have approached this Court.

In view of the above, we dispose of the present Public Interest Litigation with a direction to respondent No. 2 - District Collector, Buldhana, to consider and decide the aforesaid representation dated 9th December 2025. 6.
Respondent No. 2 shall treat the present Public Interest Litigation as also a representation submitted on behalf of the petitioners and decide the same on its own merits and in accordance with law by taking into account each and every ground raised in the present Public Interest Litigation. 7.
Respondent No. 2 shall take an appropriate decision within a period of three weeks from the date of production of a copy of this order.

The petitioners undertake to produce the copy of the present Public Interest Litigation before respondent No.2 within one week from today.

The decision taken thereupon shall be communicated to the petitioners within two weeks from the date of such decision. 10.
