The present application is filed for restoration of the appeal which came to be dismissed on 17 January 2026 for non-appearance on behalf of the applicant-appellant. The present application is filed within time. 2.

Learned advocate who was briefed in the matter, today personally appears before this Court and states that since he was in another Court, he could not attend on 17 January 2026 and by the time, he reached the Court, the order was already passed.

I have perused the application and since the advocate personally has accepted that he could not reach the Court, since he was on his legs before the another Court, there is sufficient cause for restoration of the appeal.

Accordingly, the first appeal and Civil Application No.1401 of 2016 are restored to file.
