DATE : 7 MAY, 2026 P.C. :- INTERIM APPLICATION NO. 990/2026 1) Heard Mr. Hake Patil, learned advocate appearing for the legal heirs of the respondent.
2) I have gone through the contents of the interim application. So also, a copy of the letter of the advocate for the respondent addressed to the advocate for the petitioner dated 26 March, 2026 which mentions that the respondent no.5's legal heir Mr.Sanjay Dalpat Patel having address at B/72, Sheetal Apartment, 7th
2/3 Floor, Near Radiant Hospital, Virar (East), District Palghar - 401305 and death certificate of respondent no.5 has been supplied to the advocate for the petitioner.
3) I have heard learned advocate appearing for the proposed legal heir and I have gone through contents of the interim application. I am convinced that this interim application needs to be allowed. 4) Interim application stands allowed in terms of prayer clauses (a), (b), (c) and (d).
5) So also, the applicant to bring on record the legal heirs of the deceased respondent no.5, viz., Mr.Sanjay Dalpat Patel having address as B/72, Sheetal Apartment, 7th Floor, Near Radiant Hospital, Virar (East), District Palghar - 401305.
6) This interim application is allowed subject to the applicant paying a cost of Rs.10,000/- to the Kirtikar Law Library, High Court, Bombay within a period of six weeks from today. 7) Amendment to be carried out within a period of six week from today.
8) Interim application is accordingly disposed of.
