This Application is filed by the Applicant for restoration of appeal dismissed against the Respondents for failure on the part of the Appellant to serve them. 2.

Learned counsel for the Appellant, submits that since the appeal was dismissed without serving notice to the other side, notice of the present Application to the Respondents be dispensed with. Since the Appeal and Interim Applications were dismissed before issuance of notice to the 13th March 2026

The Applicant has given satisfactory reasons for not filing Application for restoration in time. The learned counsel for the Appellant undertakes to take steps to serve Respondents within a period of three weeks. In view of the said undertaking, the Application stands allowed. The Appeal and Interim Applications stands restored to its original file and record.

In case no steps are taken within a period of three weeks from from today for effecting service on Respondents, this order shall stand vacated and Appeal shall stand dismissed. In case the copies are supplied by the Appellant for issuance of notice to the Respondents, issue notice to the Respondents returnable on 15th June, 2026.
