The contention of the learned counsel appearing for the appellant is that despite an issue of maintainability having been raised, the Joint Charity Commissioner has not adjudicated the said issue before hearing of the application on merits.

The impugned order records that the matter has reached at the stage of final argument and it is better if the matter is heard finally and SQ Pathan 1/2

36-FA-ST-3766-2026.doc hence the application was deferred to be heard along with the final arguments. This Court is informed that the matter is scheduled for hearing tomorrow. Considering that the entire matter can be heard finally, upon a query by this Court, learned counsel appearing for the parties submit that on 1st April 2026, the final arguments would be advanced by the parties both on the maintainability as well as the main merits of the matter.

In light of the same, the First Appeal is disposed of by directing the Joint Charity Commissioner to defer tomorrow's hearing to 1st April 2026, on which date, the arguments of all the parties to be concluded. 4.

It is made clear that no adjournment to be granted and the final arguments to be concluded on 1st April 2026, both on maintainability as well as the main merits of the matter.

The First Appeal is disposed of in terms of the said direction. 6.

Interim Application does not survive for consideration and stands disposed of.
