Interim Application has been preferred seeking condonation of delay of 157 days caused in filing the First Appeal. 2.

Learned counsel for the Applicant submits that, the certified copy of the records, which were unavailable with the advocate, was required to be obtained. He would further submit that legal opinion was sought, which consumed some time, and hence there is a delay. 3.

Learned counsel appearing for the Respondent opposes the SQ Pathan 1/2

101-FA-ST-3232-2026.doc application and submits that the application does not disclose sufficient cause for condonation of delay.

The application has been filed by Tata Memorial Hospitals Workers Union, and it is specifically pleaded that legal advice was obtained before filing the present First Appeal. The same constitutes sufficient explanation, as the Union would be reluctant to act without obtaining legal advice.

As there is sufficient explanation, the delay stands condoned. Application is allowed and disposed of accordingly. 6.
