For the reasons mentioned in the Interim Application, the First Appeal (ST) No. 23496 of 2019 is restored to its original file.

Ms. Nidhi Shah, learned counsel for the Applicant, seeks a stay of the impugned order dated 26th March 2018. While dismissing the First Appeal by order dated 29th January 2026, this Court recorded the earlier permission given to the Claimant to withdraw 50% of the deposited amount along with the corresponding interest on furnishing an undertaking before the Tribunal. It is an admitted fact that the 26th February 2026

923-IA-1540-2026.DOC Appellant/Applicant herein has not deposited the said amount before the Tribunal in terms of the impugned order. 3.

Ms. Shah, on instructions, submits that the Appellant will deposit the said amount in terms of the award before the Tribunal within a period of eight weeks from today. 4.

It is made clear that if the amount so directed by the Tribunal is not deposited within the stipulated time, the Appeal will stand dismissed and the present order for restoration shall remain ineffective. The prayer for stay of the impugned award at this stage, without having complied with the said order, is rejected. However, it is made clear that once the amount is deposited, the Appellant is at liberty to renew the prayer seeking a stay of the impugned order. 5.

The Interim Application is allowed and disposed of accordingly.
