By this Interim Application, the applicant seeks the following reliefs :

"a.

that, the Application be allowed;

b.

that, this Hon'ble Court be pleased to direct the registry of this Hon'ble Court to release the USA passport of Ayush which is currently in the custody of the Registrar of this Hon'ble Court;

c.

that, this Hon'ble Court be pleased to allow Ayush to travel to Illinois, USA for the period from 15/03/2026 to 31/03/2026 (both days included) to attend his Robotics Competition;

e.

for any other reliefs in the interest of justice." 2.

I have heard the learned counsel for the applicant and the respondent in person.

The applicant and the respondent are the parents of minor child Ayush, who is at present in the custody of the applicant - mother.

The respondent submits that permission as sought may not be granted. It is submitted that if such permission is granted then the applicant may take the child to U.S. and may not return as they both are U.S. citizens.

The learned counsel for the applicant submits that permission is sought in respect of child Ayush. It is submitted that to ally the apprehension of the respondent, the applicant is ready to deposit her Passport with the Registrar (Judicial-I) of this Court. 6.

Considering the overall facts and circumstances, the application is allowed in terms of prayer clauses (b) and (c), subject to condition that the applicant shall deposit her Passport with the Registrar (Judicial-I) of this Court. 7.

Needless to mention that the Registrar (Judicial-I) shall not hand over the Passport of the minor child Ayush to the 2/3

applicant, unless she deposits her Passport with him. 8.

The Application is disposed of in the aforesaid terms. 9.

The applicant shall ensure that the minor child Ayush comes back to India by 31st March 2026. The assurance given by the applicant to that effect is accepted as undertaking to this Court.
