CORAM : BHARATI DANGRE & MANJUSHA DESHPANDE, JJ DATED :13th MARCH, 2026 P.C:- IA No. 1845/2026 seek condonation of delay of 66 days in filing the Family Court Appeal, raising a challenge to the judgment dated 18/8/2025 passed by the Family Court, Nasik in Petition No.A-286/2023.

The judgment would reveal that the same is exparte as the respondent wife has been marked absent and the judgment is delivered in absentia.

Heard learned counsel for the applicant and perused the application which seek condonation of delay. Tilak

2/2 21 IA 1845-26.doc On perusal of the reasoning in the application, where it is categorically stated that since she was proceeded exparte and though the judgment state that there was paper publication, she was not served with any notice, nor did she come across any paper publication.

Sufficient explanation is also offered as to why the Appeal could not be filed within time and since we are satisfied with the bonafides, IA is made absolute in terms of prayer clause (b).

Registry is directed to register the Family Court Appeal.
