The Applicant has preferred the present Interim Application seeking deletion of the name of the original Appellant no.2, who is stated to have passed away on 10th April 2025 and to implead his heirs and legal representatives in his place and stead in the present First Appeal. I have heard both the parties and perused the Interim Application.

For the reasons set out therein, the delay of 229 days is required to be condoned and the present Interim Application is required to be allowed in terms of the following order:

(ii) The Applicant is permitted to amend the cause title of the Appeal in terms of the schedule annexed to the present Interim Application.
